• Rules of evidence 801 defines hearsay as-“ a statement other than one made by the declarant while testifying at trial offered in evidence to prove the truth of the matter asserted.”
• The three rules that must be adhered to are
1. The statement isn’t the same as the original “declarants” persons testimony that they gave while under penalty of perjury
2. The statement is the same as the “declarant” and is used to back up their original story.
3. The statement identifies the person after the witness has seen them
• The Frye case, for example, is all about whether it is admissible in a trial that a parson is telling a lie based on increased blood pressure. The way this is used is to debate whether the process is scientific of experimental.
